In consideration for my child being permitted to participate in The OH Line Academy’s training programs (the “Program”), coached by Tyrel Detweiler at 8500 Warner Rd. Suite 200, Plain City, OH 43064, and at any additional auxiliary locations, (collectively the “Facility”), on behalf of my child, myself, our family, our heirs, and assigns, I hereby release The OH Line Academy, Detweiler Chiropractic Health Services, LLC (collectively the "Company"), Tyrel Detweiler, and each of their respective employees, agents, representatives, and affiliates from any and all liability for personal injury, including death, or property damage or loss suffered by my child as a result of, arising out of, or in any way involving participation in this Program, except to the extent that such liability results directly from the negligence of the Company, its agents or employees.

Consent and Waivers:

I acknowledge that I know, understand, and appreciate the inherent risks associated with my child’s participation in Program activities. These risks may include but are not limited to; scrapes, sprains, strains, contact with other participants, head injury, neck injury, paralysis, or other bodily injuries; or death; and damage to or loss of personal property. The risks include exacerbation of pre-existing medical conditions. I fully assume the inherent risks associated with my child attending this Program and assert that my child has chosen to participate in this Program, with my express approval.

I understand that all activities at the Facility include inherent risks that cannot be totally eliminated regardless of the care taken by the Facility. I acknowledge, understand, and appreciate the types of injuries inherent in the Facility’s activities, and hereby knowingly assumes all inherent risks of such activities. Furthermore on behalf of myself, my spouse, heirs, personal representatives, and assigns (collectively “Releasing Parties”) does hereby knowingly and voluntarily, fully and forever, waive, release, discharge and covenant not to sue the Facility for alleged liability from any and all claims arising from the ordinary negligence of the Facility and any of its current and former principals, directors, officers, employees, agents and representatives (“Protected Parties”).

This agreement applies to personal injury, including death, from the incidents or illnesses arising from participation in the Facility’s activities including, but not limited to recreational, practice, or competitive activity; events; organized or individual training and conditioning activities; tests; classes and instruction; individual use of facilities, equipment, and all premises, or attendance at such activities whether or not as a participant, including the associated structures, property, and parking lots, and to any and all claims resulting from the damage to, loss of, or theft of property (the inclusive activities).

I also agree to hold harmless, defend, and indemnify the Facility that is, defend and pay any costs, including damages awarded, investigation costs, reasonable attorney’s fees, and related expenses from any and all claims arising from my child’s participation in the activities at the Facility. I further agree to hold harmless, defend, and indemnify the Facility against any and all claims of co participants, rescuers, and others arising from the conduct of the Participant/Parent or its child in such activities.

I grant the Facility and persons acting for or through them the right to use, reproduce, assign, and/or distribute images, audio and video recordings, and likenesses in any medium whatsoever, of my minor children, identified above, for whom I have custody, for the purpose of promoting the Company. I grant the Company, its successors, and assignees own all right, title and interest, including the copyright, to any such image, recording, or likeness.

I hereby release and hold harmless the Facility and each of their respective employees, agents, representatives, and affiliates; including Hybrid Performance Group LLC, from any and all claims, including but not limited to claims of infringement, damages or remuneration, for invasion of privacy, defamation, or misappropriation, or otherwise arising from such use.

In the event my child requires medical care while attending the Program, all reasonable attempts will be made to contact me at the phone numbers provided to obtain consent for treatment. In the event you are unable to reach me, emergency treatment may be provided as needed. If in the judgement of the healthcare provider the medical care is not an emergency, no treatment will be provided until my consent has been provided by phone or in person.

Policies

Cancellation Policy:

​

All sales are final. Should you choose to cancel your child’s participation in our Programs, you will forfeit any deposits made to hold your child’s spot in the camp.

​

Should your camp time or location change, you will be notified with the option to be refunded or accept the new location and time of the camp. A request for refund must be made within 5 business days of notification of camp change. Failure to request a refund after 5 business days will result in automatic acceptance of new camp location and time.

Should your camp be cancelled by The OH Line Academy for any reason, you will be refunded for your camp payment or given the option to enroll in a different camp if available.

Weather Cancellation and Missed Practice Policy:

​

All practice cancellations due to weather will be determined by Coach Detweiler. In the event of cancellation due to weather conditions, parents and/or athletes will be given reasonable notice via text and email prior to their practice session. 
 

Should an athlete miss a practice that was not cancelled by Coach Detweiler due to weather, holiday, vacation, sickness, etc., the athlete will forfeit the missed practice without make-up. Forgiveness of missed practices due to extenuating circumstances may be considered on a case by case basis.

Practice Make-Ups and Refund Policy:

​

Up to two practices may be rescheduled by Coach Detweiler per each month due to weather cancellation. Due to time and scheduling constraints, practices missed due to weather cancellation will be made up at the discretion of Coach Detweiler. Missing a rescheduled practice will be treated in the same manner as missing a normally scheduled practice.
 

If a practice is unable to be rescheduled or the number of practices missed due to weather exceed the allotted two practices, the following options will be made available for lost practice time:

1. Substitution of a missed practice with a Parent/Coach meeting Coach Detweiler. This meeting will consist of a (video optional) call to provide parents and athletes an opportunity to speak individually with Coach Detweiler. It includes an evaluation of your child’s current strengths within our programs, as well as his weaknesses and solutions to address them. You will also have the opportunity to ask any questions in regards to your child and our programs.

2. Account credit with The OH Line Academy that is equal to $25 per session. This account credit can be used for the purchase of any product or service provided by The OH Line Academy.

Agreement and Acknowledgement:

​

I am submitting a registration for my child to participate. I acknowledge that I have read and understand this agreement. I acknowledge and understand that it is giving up substantial rights, including the rights of my child to sue for damages in the event of death, injury, or loss. I acknowledge that I am voluntarily agreeing to these terms, conditions, waivers and releases and intend this agreement to be a complete release of all liability, including that due to ordinary negligence by the Protected Parties, to the greatest extent allowed by the laws of the State of Ohio. Finally, I take full responsibility for knowing and abiding by the rules of the Facility and understand and acknowledge that if I do not abide by the rules of the Facility, I risk being banned from the Facility and having all of my money forfeited.

By signing this registration form I certify that: I am the parent/legal guardian of the participant named on this registration form; I understand and accept the risks associated with my child's participation; I understand and agree to all terms of the above.
